Rental Agreement & Terms and
Conditions

This Agreement is entered into between the Owner/Operator (hereinafter “Owner” or “Company”) and the Lead Guest (“Guest”).
By sending payment in response to an invoice, you confirm that you, along with every accompanying guest, fully understand and agree to all the terms and conditions below. No modifications are valid unless provided in writing and dated by the Owner.

3. Booking, Payment, and Cancellation

Booking Confirmation
A booking becomes a binding agreement only upon receipt of all scheduled payments on time. Payment submission constitutes acceptance of these terms.

Payment Schedule:
50% deposit upon booking; balance due 60 days prior to arrival (or full payment if booked within 60 days).
Failure to Pay:
Late or non-payment may result in cancellation without notice.
Security Deposit:
A damage deposit must be provided 48 hours before arrival. It will be refunded (less any deductions for damage or additional cleaning) within 14 days after departure.

Cancellation Policy

All cancellation or reservation changes (including date or guest number alterations) must be submitted in writing.

Cancellation fees apply as specified at the time of booking.

Cancellations made within 60 days of your scheduled arrival: This will result in the loss of your initial deposit and any further rental payments, though your security/damage deposit will be refunded.

For cancellations outside of the 60-day window: if we can rebook the dates for the same price and length of stay, a partial refund may be considered—after deducting costs for targeted advertising, administrative time, and any price or date differentials. Any refund will only be paid after the scheduled arrival date and once payment has been processed for an alternative booking.

Travel Insurance Highly Recommended: To protect yourself against unexpected events like illness or emergencies, we strongly recommend purchasing comprehensive personal travel insurance as soon as you book—ASAB.

If needed, the host will provide a letter for your insurance company to verify this policy. Thank you for your understanding and cooperation.

No refunds will be granted for no-shows, late arrivals, early departures, or reductions in party size unless a serious, unremediable problem occurs at the property.

Owner Cancellation In the event of an Owner cancellation, all amounts paid toward accommodation will be refunded.

4. Check-In, Check-Out, and Property Access

Requests for late check-out must be approved in writing in advance and may incur additional charges.

Property Access & Keys

Property Access The property uses a key box entry system if the Owner is unable to welcome you in person. A temporary key box access code will be provided.

Designated people (maintenance, changeover team) may enter the property for repairs or cleaning; every effort will be made to schedule such visits at a convenient time.

5. Use of Property, Occupancy, House Rules, Pets and Events

General Use
The property is to be used solely as a private holiday residence. Use for any other purpose, including any illegal or dangerous activities, is prohibited. The Guest and accompanying persons must not disturb neighboring properties.

Occupancy
• Only the guests listed in the booking confirmation may stay on the property.
• If the group misrepresents its size, excess persons must leave the property immediately and must not return. Excess persons will be viewed as trespassers.
• Violation is grounds for immediate eviction of all guests and forfeiture of rental funds.

House Rules, Pets & Events
• No smoking or vaping is allowed inside the property.
• Noise must be kept to a minimum, especially after 22:00 hrs.
• No parties or gatherings exceeding the scheduled number of guests are permitted.
• Violation may result in eviction, forfeiture of the security deposit, and additional charges.

Pets
• No animals or pets are allowed unless prior written permission is granted.
• Specific pet rules (including fees and restrictions) apply based on the property:
• Clevelands Country House & Apartments: Two dogs allowed with approval and a £25 fee per dog per stay.
• Jersey Cottage: Only assistance dogs are permitted.

Events and Gatherings
• The property is rented to responsible adults only.
• Unauthorised gatherings or parties are grounds for immediate eviction.

6. Maintenance, Complaints, and Repairs

• The Owner works with property management team to keep the property in good order. In case of maintenance issues, notify the Owner by text or by phone call if urgent.
• A reasonable time will be allowed to resolve the problem.
• No refunds or rate adjustments will be provided for unforeseen mechanical failures or service disruptions (e.g., electricity, water, internet).

7. Rates, Errors, and Amendments

• All rates and property details are subject to change until payment is received.
• The Owner is not liable for any printing errors or omissions.
• No alterations to these Terms & Conditions are valid unless an amended copy is provided in writing and dated by the Owner.

8. Liability, Indemnity, and Hold Harmless

• Limitation of Liability: The Owner/Company is not liable for property loss, damages, personal injury, or accidents during your stay, except in cases of gross negligence or willful misconduct.
• Indemnification:The Guest agrees to indemnify and hold the Owner harmless from any claims arising from the Guest’s use of the property.
• Hold Harmless:The Guest releases the Owner from any claims, losses, or damages (including those resulting from transportation delays or acts beyond the Owner’s control, such as acts of God, war, or pandemics).

9. Security and Additional Provisions

• Security Deposits: A damage deposit is required and refundable provided there is no breakage, damage, missing items, or extra cleaning charges.
• A valid credit card may be required as additional security. The Owner reserves the right to charge for substantiated damage claims.
• Property Keys and Access: Guests must adhere to locking all windows & doors when leaving the property.
• Use of Hazardous Materials: The Guest must not bring illegal substances, hazardous materials, fireworks or flammable fluids onto the property.
• Violation is grounds for immediate eviction and forfeiture of rental funds.

10. Governing Law and Dispute Resolution

Governing Law: This Agreement shall be governed by the laws of the country of the Owner (typically the United Kingdom).
Dispute Resolution: In the event of any dispute, the Parties agree to negotiate in good faith. Failing resolution, the matter will be submitted to mediation or arbitration in the designated locale (e.g. Isle of Wight).

11. Entire Agreement and Signatures

• This document represents the entire agreement between the Parties, superseding all prior understandings or arrangements.
• Amendments must be made in writing and signed by both Parties.
• By signing below, the Parties acknowledge that they have read, understood, and agreed to all the terms and conditions set forth in this Agreement.
